Welcome to Loop BCD. These Terms of Use (“Terms”) govern your use of loopbcd.com (the “Site”), a culture and events directory for Metro Bacolod operated by Loop Bacolod (“Loop BCD,” “we,” “us,” or “our”).
By using the Site, creating an account, or submitting content, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who can use the Site
You must be 18 years of age or older to create an account or submit a listing. If you are under 18, you may do so only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.
If you use the Site on behalf of a business, group, band, venue, or organization, you confirm that you are authorized to act for it and to bind it to these Terms.
2. Your account
- Give accurate information when you register, and keep it up to date.
- Keep your password confidential. You are responsible for all activity under your account.
- Tell us right away if you think someone else has accessed your account.
- One person or organization may not use multiple accounts to get around a suspension or these Terms.
We may suspend or close accounts that break these Terms (see Section 11).
3. Listings
The Site lets you submit listings for Creatives, Locales, Events, and Firestarter projects.
3.1 Review before publishing
All listings are reviewed before they are published. We may approve, edit for formatting or clarity, categorize, decline, or remove any listing at our discretion, including listings that are incomplete, inaccurate, or outside the scope of the directory. Publishing a listing is free unless we clearly tell you otherwise.
3.2 Your responsibilities
When you submit a listing, you confirm that:
- the information is accurate, current, and not misleading, and you will update it if it changes;
- you own, or have permission to use, every photo, logo, video, and piece of text you submit;
- you have permission from every person named or pictured in your listing (for example, band members); and
- any business, event, or activity you list is lawful and has any permits it needs.
3.3 Public information
Listing content, including any point-of-contact details you choose to provide, is shown publicly once approved. Please only include contact details you are comfortable making public.
3.4 Menus and custom pages
If you ask for a Menu tab, you send us the menu content separately (for example, through our Facebook page). We may format it to fit the Site.
Requests for a custom-designed Loop BCD page (offered for a donation) or for a website of your own (subject to a quotation) are separate arrangements. Selecting either option only gives us permission to contact you about it. The scope, price, and timeline of any such work will be agreed with you separately before any work begins.
4. Content you post
“User Content” means anything you submit to the Site, including listings, photos, videos, reviews, ratings, comments, inquiries, and Firestarter responses.
4.1 You keep ownership
You keep ownership of your User Content.
4.2 License you give us
By submitting User Content, you give Loop BCD a non-exclusive, royalty-free, worldwide license to host, store, reproduce, display, format, resize, and distribute it in order to operate and promote the Site. This includes sharing approved listings on Loop BCD’s own social media channels and in search engine results.
This license ends when you delete the content or ask us to remove it, except for copies kept in backups for a reasonable time, content that has already been shared on social media, and content kept where the law requires.
4.3 What you may not post
You may not submit content that:
- is false, misleading, fraudulent, or impersonates someone else;
- infringes anyone’s copyright, trademark, privacy, or other rights;
- is defamatory, harassing, hateful, threatening, obscene, or sexually explicit;
- promotes violence, illegal activity, illegal drugs, or gambling;
- exposes anyone’s private information without their consent;
- contains spam, chain messages, unrelated advertising, malware, or links to harmful sites; or
- violates any law of the Philippines.
We may remove any User Content that breaks these rules, without notice.
5. Reviews and ratings
Reviews should reflect your genuine, first-hand experience. You may not:
- review your own listing, or a competitor’s listing to harm it;
- post reviews in exchange for payment, gifts, or other incentives without clearly saying so; or
- post multiple reviews of the same listing to manipulate its rating.
Reviews express the opinions of the people who write them, not of Loop BCD. We may moderate or remove reviews that break these Terms.
6. Inquiries and Firestarter projects
The Site helps people connect through inquiries and Firestarter projects (such as collaborations, freelance work, volunteer calls, and venue or equipment needs).
Loop BCD is not a party to any arrangement between users. We are not an employer, recruitment or placement agency, talent manager, booking agent, or broker. We do not screen users, verify credentials, guarantee payment, or supervise any work, event, or transaction.
Any agreement you make with another user is solely between you and that user. Please use good judgment: verify who you are dealing with, agree on terms in writing, and never send money or personal documents to anyone you have not verified.
7. Events
Event details such as dates, times, prices, venues, and availability are provided by the people who submit them and can change. Always confirm details with the organizer before attending. Loop BCD is not responsible for cancelled, postponed, or changed events, or for anything that happens at an event.
8. Acceptable use of the Site
You agree not to:
- use bots, scrapers, or automated tools to collect data from the Site without our written permission;
- collect other users’ contact information to send unsolicited messages;
- try to access accounts, systems, or data you are not authorized to access;
- interfere with the Site’s security, spam protection, or performance; or
- use the Site in any way that breaks the law or these Terms.
9. Our content and trademarks
The Site’s design, logo, name, text, and graphics created by Loop BCD are owned by Loop BCD or its licensors and are protected by the Intellectual Property Code of the Philippines (Republic Act No. 8293) and other laws. You may not copy, modify, or use them without our written permission, except to share links to the Site or to your own listing.
10. Copyright complaints
If you believe content on the Site infringes your copyright or other rights, email [contact email] with:
- your name and contact details;
- a description of the work or right you believe is infringed;
- the link to the content on the Site; and
- a statement that the information in your notice is accurate and that you are the rights holder or authorized to act for them.
We will review the notice and may remove the content. We may close the accounts of users who repeatedly infringe others’ rights.
11. Suspension and termination
We may suspend or close your account, or remove your content, if you break these Terms, if required by law, or to protect Loop BCD, our users, or the public.
You may stop using the Site at any time and may ask us to delete your account and listings by contacting us. Sections 4.2 (for the limited cases described there), 6, 7, and 12 to 16 continue to apply after your account ends.
12. Disclaimers
The Site and all listings are provided “as is” and “as available.” Listings are submitted by users, and although we review them before publishing, we do not guarantee that any listing, review, or event detail is accurate, complete, current, or reliable.
We do not endorse any creative, venue, business, event, or project listed on the Site. We do not guarantee that the Site will always be available, uninterrupted, or error-free.
13. Limitation of liability
To the fullest extent permitted by Philippine law, Loop BCD and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or goodwill, arising from:
- your use of, or inability to use, the Site;
- any listing, review, or other User Content;
- any event, transaction, collaboration, or arrangement between users; or
- any unauthorized access to your account that was not caused by our negligence.
Nothing in these Terms limits liability that cannot be limited under Philippine law, including liability for fraud, gross negligence, or willful misconduct.
14. Indemnity
You agree to indemnify and hold harmless Loop BCD and its operators from any claims, damages, losses, and costs (including reasonable legal fees) arising from your User Content, your use of the Site, your dealings with other users, or your breach of these Terms or of anyone’s rights.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above. For significant changes, we will give additional notice on the Site or by email. Continuing to use the Site after an update means you accept the revised Terms.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines. Before starting any formal proceeding, please contact us first so we can try to resolve the matter informally.
Any dispute that cannot be resolved informally will be brought exclusively before the proper courts of Bacolod City, Negros Occidental, to the exclusion of all other venues.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
